Heard learned counsel for the petitioner. In view of the order being passed notice to opposite parties is dispensed with. Petition under Article 227 of the Constitution of India has been filed seeking a direction to the opposite party no.1 to consider and decide application for temporary injunction filed by the petitioner in Regular Suit No.80/2022 instituted by the petitioner for partition. It has been submitted that in the aforesaid suit proceedings all the three defendants have put in appearance and have also filed written statement but in view of the fact that construction activity has been started on the property in question, the aforesaid application for temporary injunction has been filed and is pending consideration. In view of the urgency shown by the learned counsel for the petitioner the opposite party no.1 is directed to decide the pending application for temporary injunction in Regular Suit No.80/2022 expeditiously, preferably on the next date fixed in case all the defendants have appeared and filed their objections therein, failing which the Court may also consider for grant of interim injunction in case the petitioner is able to make out the case for grant of same.
