Judgment

Court No. - 20 Case :- WRIT - A No. - 9952 of 2023 Petitioner :- Constable Kashi Nath Singh Respondent :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lucknow And 2 Others Counsel for Petitioner :- Rakesh Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petition has been filed challenging notice dated 6th November, 2023. Further prayer for direction to oppsotie parties to allow petitioner to retain government accommodation till April, 2024 has also been made. Mr. Aniruddh Singh learned State Counsel has however submitted that petition itself is not maintainable since it is premature and has been filed only against a show cause notice to the petitioner to which reply has already been submitted by him and cause of action will arise only after final decision on his reply. It appears that as of now only show cause notice has been issued to petitioner to which he has already submitted a reply. As such it does not appear that any cause of action as of now accrues to petitioner for maintaining this petition. However it is provided that petitioner may approach this court again as and if final orders are passed against him in consideration of his reply. The petition stands disposed of. Consigned to record.
