Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 6459 of 2023 Petitioner :- Sheshmani Pandey Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Lko And 3 Others Counsel for Petitioner :- Rahul Roshan Dubey Counsel for Respondent :- C.S.C. Hon'ble Rajnish Kumar,J. On an objection raised by Sri Upendra Singh, learned Additional Chief Standing Counsel that State of U.P. has wrongly been impleaded in this petition, Sri Rahul Roshan Dubey, learned counsel for the petitioner submits that inadvertently State of U.P. has been impleaded and he may be permitted to delete the same and re-number the other respondents. To which there is no objection by the other side. In view of above, learned counsel for the petitioner is permitted to delete the respondent no.1/State of U.P. from the array of parties and re-number the respondent nos.2,3 and 4 as respondent nos.1,2, and 3 during course of the day. Heard. This petition has been filed for direction for disposal of Regular Suit No.337/2021(Sheshmani versus Adarsh Pandey and others) for cancellation of Will and temporary injunction, which is pending since 02.07.2021. Learned counsel for the petitioner after arguing at some length restricts his prayer for direction for disposal of temporary injunction application at this stage. Considering the nature of order proposed to be passed, requirement of issuance of notice to the respondent nos. 2 and 3 is dispensed with. Respondent No.1 is the court concerned. Perusal of the order sheet indicates that the temporary injunction application is not being pressed by the petitioner. However if the same is pending, the same should have been considered and disposed of. In view of above, without entering into the merits of the case, the petition is disposed of with liberty to the petitioner to move appropriate application for expeditious disposal of the application for interim injunction before the concerned court. In case any such application is moved by the petitioner within a period of two weeks from today, the concerned court shall consider the same and pass appropriate orders thereon within a period of two weeks thereafter and proceed accordingly in accordance with law. .
