Nafees, learned counsel for the petitioner submits that the petitioner and the respondent nos. 5 to 7 have filed Regular Suit No. 168 of 2020 for permanent injunction. The petitioner is aged about 75 years.Therefore a direction may be issued for disposal of the suit within some stipulated period,being a case of old age person. However, learned counsel for the petitioner failed to show any other urgency in the matter. Even otherwise, any such prayer for disposal of suit in a time bound manner or any other ground can be raised before the concerned court and the concerned court can consider the same in accordance with law. Considering the nature of order proposed to be passed, requirement of issuance of notice to the opposite party nos.1 to 7 is dispensed with. Without entering into the merits of the case, the petition is disposed of with liberty to the petitioner to move appropriate application before the concerned court for expeditious disposal of the suit showing the ground of urgency and as to why the case should be given preference over and above other old cases pending in the court. In case any such application is moved by the petitioner within two weeks, the same shall be considered by the concerned court and pass the appropriate order and shall proceed accordingly as per law.
