Court No. - 7 Case :- WRIT - A No. - 10043 of 2023 Petitioner :- Pooja Saurabh Bajpai Respondent :- Managing Director U.P. Power Corporation Ltd. Lko. And 2 Others Counsel for Petitioner :- Dileep Kumar Srivastava,Jaideep Srivastava,Rajendra Singh Negi Counsel for Respondent :- Neerav Chitravanshi,A0453 Hon'ble Abdul Moin,J. Heard learned counsel for the petitioner and Shri Neerav Chitravanshi, learned counsel appearing for the respondents. With the consent of learned counsel appearing for the contesting parties, the writ petition is being finally disposed of. The contention is that the petitioner is a widow daughter of Late Shri Vinod Shanker Mishra who was the employee of the Corporation and died on 04.04.2018. Subsequent thereto, the family pension was given to the mother of the petitioner who too has died on 11.10.2023. It is contended that the husband of the petitioner died on

07.11.2020 and now the petitioner is a widow and consequently she is entitled for being paid the family pension in terms of the order issued by the Corporation itself dated 16.05.2015, a copy of which is annexure 3 to the petition. Learned counsel for the petitioner, after arguing at some length, prays that in this regard the petitioner may be permitted to approach the competent authority for the payment of family pension and the competent authority be required to decide the application of the petitioner in accordance with law within a specified time to which Shri Neeraj Chitravanshi, learned counsel for the respondents has not objection. In view of the above, the writ petition is disposed of and the petitioner is permitted to submit an application for grant of family pension in the capacity of she being the widowed daughter of the deceased employee. In case such an application is moved before the competent authority within a period of two weeks from today then the competent authority shall proceed to decide the same in accordance with law within next eight weeks from the date of submission of the representation along with certified copy of this order. It is made clear that this Court has not gone into the merits of the claim set forth by the petitioner. Order Date :- 22.12.2023 S. Shivhare High Court of Judicature at Allahabad, Lucknow Bench
