¶1Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties.

¶2Petition has been filed seeking a direction to opposite parties for issuance of appointment letter to petitioner in pursuance of his selection on the basis of advertisement dated 26.03.2019 on the post of Constable.

¶3Learned counsel for petitioner has drawn attention to call letter dated 08.08.2019 to submit that the same clearly indicates that petitioner has been selected in the aforesaid recruitment but appointment letter has not yet been issued.

¶4Learned State counsel has been provided written instruction dated 02.12.2023 which is taken on record to submit that petitioner's appointment letter was not issued on account of two criminal cases pending against him.

¶5Learned counsel for petitioner however submits that he has already submitted a representation to the opposite parties dated

20.06.2023 in which he has clearly indicated that petitioner has already been acquitted in both criminal proceedings.

¶6Considering innocuous prayer being made by learned counsel for petitioner and without entering into the merits of the case, opposite party No.2 i.e.Commandant, 10th Battalion PAC, Barabanki is directed to consider and decide petitioner's grievance in the light of his representation dated 20.06.2023 within a period of six weeks from the date a certified copy of this order is produced before said authority. Petitioner shall annex copies of acquittal orders, copy of representation dated

20.06.2023 as well as copy of this order. He shall also indicate as to whether any appeal is pending against the said acquittal orders.
