¶1Heard learned counsel for the petitioner and learned Standing Counsel for the State.

¶2Learned counsel for the petitioner submits that Case No.T202304040107326 of 2023 (Abu Tolha Ansari vs. Shakeel Ahmad Ansari and another) filed by the petitioner under Section 5 of the Parents and Senior Citizen Act, 2007 is pending before respondent no.3-Sub Divisional Magistrate, Tehsil Akbarpur, District Ambedkar Nagar since October, 2023. Learned counsel for the petitioner submits that grievance of the petitioner would be sufficiently met in case respondent no.3 considers and decides the aforesaid case in a time bound manner.

¶3Looking into the facts and circumstances of the case, without entering into the merits of the case, respondent no.3-Sub Divisional Magistrate, Tehsil Akbarpur, District Ambedkar Nagar is directed to proceed with Case No.T202304040107326 of 2023 (Abu Tolha Ansari vs. Shakeel Ahmad Ansari and another) filed by the petitioner under Section 5 of the Parents and Senior Citizen Act, 2007 and decide the same in accordance with law, by a reasoned and speaking order, as expeditiously as possible, say within a period of thirty days from the date, a certified copy of this order is placed before him, after hearing all the parties concerned.
