¶1The present petition has been filed by the petitioner challenging the recovery-cum-auction dated 02.01.2024 whereby the Bank is taking steps for recovery of the amount through auction.

¶2The Counsel for the Bank Sri Sanjeev Kumar Singh on instructions states that an amount of Rs.3,60,891/- is due and payable by the petitioner.

¶3The Counsel for the petitioner on instructions states that the petitioner is ready and willing to pay the entire outstanding if some suitable time is granted.

¶4The Counsel for the respondent Bank has no objection to the proposal made by the Counsel for the petitioner.

¶5In view of above, the present writ petition is disposed off directing the petitioner to pay the outstanding amount in six equal installments. The first installment of Rs.60,000/- shall be payable by the petitioner on or before 15.02.2024, the second installment by 15.05.2024, third installment by 15.08.2024, fourth installment by 15.11.2024, fifth installment by

15.02.2025 and the last installment by 15.05.2025. The last installment shall include the overdue interest.

¶6In case of default, the present order shall automatically come to an end and the respondent Bank has right to recover the loan amount in accordance with law.

¶7It is made clear that the petitioner shall not be required to pay any recovery charges if the amounts are paid as directed above. Order Date :- 22.12.2023 akverma High Court of Judicature at Allahabad, Lucknow Bench
