¶1Heard learned counsel for the petitioner and learned Standing Counsel for the State.

¶2The petitioner has filed an appeal bearing no.C202310000002956 of 2023 under Rule 15 of U.P. Minerals (Prevention of Illegal Mining Transportation & Storage) Rules, 2018 before respondent no.2-Commissioner, Lucknow Division, Lucknow on 16.10.2023 along with an application for condonation of delay and stay.

¶3Learned counsel for the petitioner submits that till date, even delay condonation application has not been decided and now recovery certificate has been issued.

¶4Looking into the facts and circumstances of the case, respondent no.2-Commissioner, Lucknow Division, Lucknow is directed to decide the delay condonation application and stay application filed along with the aforesaid appeal in accordance with law after hearing all parties concerned within a period of two weeks from the date, a certified copy of this order is placed before the authority concerned. The appeal may also be decided expeditiously in accordance with law.
