¶1Heard learned counsel for parties.

¶2Petitioners have approached this Court claiming that Gata no.372 situated at Village Mukhalishpur, Vikas Khand Isanagar, District Lakhimpur Kheri, which is recorded as Shamshan, is not being used as Shamshan and hence, should not be used as Shamshan any further as the petitioners have raised their abadi on Gata no.372.

¶3This Court cannot go into the factual dispute as to whether Gata no.372 is being used as Shamshan or not.
