¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties 1, 3 & 4 and Mr. Shikhar Anand, learned counsel for opposite party no.2.

¶2In view of order being passed notices to opposite party no.5 stand dispensed with.

¶3Petition has been filed challenging orders dated 01.05.2023 and 08.05.23 as well as Order dated 17.01.2023 imposing monetary penalty against petitioner who was the Public Information Officer on the allegation that he did not provide the relevant information within the time stipulated.

¶4It has been submitted by learned counsel for both the parties, that there is a statutory provision for filing a recall in terms of Rule 12 U.P. Right to Information Rules, 2015, which has already been availed of by petitioner by Recall Application dated 25.04.2023.

¶5At present, learned counsel for petitioner restricts prayer with regard to final decision on the Recall Application.

¶6Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no.2 i.e. Information Commissioner, State Information Commission U.P., Lucknow who shall consider and decide the Recall Application within a period of six weeks from the date a certified copy of this order is produced before the said authority.
