Judgment
Court No. - 1 Case :- FIRST APPEAL No. - 246 of 2023 Appellant :- Brijesh Sant Kumar Pandey Respondent :- Himanshi Mishra Alias Kiran Mishra Counsel for Appellant :- Rakesh Pathak,Vijay Pathak Hon'ble Attau Rahman Masoodi,J. Hon'ble Jaspreet Singh,J. This appeal has been preferred under Section 19(1) of the Family Courts Act, 1984. The proceedings under Section 13(B) of the Hindu Marriage Act, 1955 have failed due to withdrawal of consent by the opposite party. It is not disputed that one of the party (wife) has withdrawn the consent despite a settlement having taken place out side the Court, which we cannot take cognizance of in the present appeal. Leaving it open to the appellant for availing the appropriate remedy available under law, appeal is not maintainable against the order passed by the Family Court. The appeal is, accordingly, rejected. Order Date :- 22.12.2023 Ashutosh Pandey High Court of Judicature at Allahabad, Lucknow Bench
