¶1Heard Sri Shahid Salam, Advocate holding brief of Sri Mohd. Shamim, learned counsel for petitioner, Sri Dilip Kumar Pandey, learned counsel for respondent no.5 and learned Standing Counsel for State.

¶2Present writ petition is filed by the petitioner claiming that he was granted a patta i.e. Gata No.152 Minjumla and land measuring 0.045 hect. separately in compliance of order dated

11.01.1999 in village-Rani Nagar Colony, Tehsil-Paliya, District-Lakhimpur Kheri by Government, however, without giving any notice or opportunity of hearing, respondent authorities are proceeding to demolish the house of petitioner.

¶3Learned Standing Counsel fairly concedes that respondents can only take action against petitioner after giving due notice or opportunity of hearing.

¶4In view thereof, respondent no.3 Sub-Divisional Magistrate, Paliya, District-Lakhipur Kheri shall ensure that no action is taken against petitioner, except in accordance with law.
