Heard learned counsel for the applicants, learned AGA for the State of U.P. and perused the record. The present application under Section 482 Cr.P.C has been filed by the applicants with the prayer to quash/set-aside the order dated 21.10.2023 passed by Additional Chief Judicial Magistrate-IIIrd, Lucknow in Criminal Case No. 23693/2020 arising out of Case Crime No. 110/2019, under Sections 419, 420, 447, 506 IPC, Police Station Chinhat, District Lucknow. At the very outset, Ms. Swati Upadhyay, learned AGA stated that earlier the applicants approached this Court by means of an application U/S 482/378/407 No. 3687 of 2021 (Khalikunnisha & Others vs. State Of U.P. Thru. Prin. Secy. Home. Lko & Others) challenging the charge sheet as also the order passed by trial court, in compliance whereof, the bailable warrant were issued against the applicants and this fact has not been disclosed in this application. On confronting regarding aforesaid, learned counsel appearing for the applicant says that he does not want to press this application and it may be dismissed accordingly.
