¶1Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties.

¶2Petition has been filed seeking the following reliefs:- "(i) issue a writ order or direction in the nature of mandamus commanding the Respondents to pass the directions for grant of Notional promotion to the Petitioner from the date 15.10.1993 when his juniors were promoted and to grant him pension including/counting his services of Kanpur Medical College Northern Railway Bikaner and Northeastern Railway Gorakhpur and pay him difference in salary treating him to be promoted to the post of Additional Director/Director, expeditiously, within specified time.

(ii) issue a writ order or direction in the nature of mandamus commanding the Respondents to grant him higher pay scale, difference of salary and pension and other consequential benefits, expeditiously, within specified time. ......................"

¶3For the aforesaid grievance, petitioner has already submitted a representation but seeks liberty to file fresh representation before competent authority. At present learned counsel for petitioner restricts his prayer for a final decision with regard to same.

¶4Considering innocuous prayer being made by learned counsel for petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No.1 i.e. Principal Secretary, Medical and Health, U.P. Civil Secretariat, Lucknow. In case such a representation is filed, the same shall be considered and decided within a period of eight weeks from the date a certified copy of this order is produced before the said authority.
