¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed seeking a direction to the concern ed authority for considering petitioner's application for compassionate appointment in place of late Vikash Kumar Chaudhary who is brother of petitioner.

¶3It has been submitted that petitioner is the only surviving heir of deceased employee, who was unmarried and passed away on

03.11.2018. Petitioner has already submitted an application dated 12.12.2023 for compassionate appointment which is still pending consideration.

¶4Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no. 2 i.e. Commissioner Food and Civil Supplies Jawahar Bhawan Lucknow Uttar Pradesh who shall consider and decide the same within a period of six weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
