¶1Heard learned counsel for the petitioner, learned A.G.A. for the State-respondents.

¶2This petition has been filed with the following main prayer:- "I. issue a writ, order or direction in the nature of CERTIORARI thereby quashing the impugned First Information Report dated 28.12.2019 registered as F.I.R No. 1628/2019, U/S 409, 420 IPC at Police Station-Gomti Nagar, District-Lucknow, annexed as Annexure No. 1 to this writ petition. II. issue a writ, order or direction in the nature of Mandamus thereby commanding the opposite parties not to arrest the Petitioner in pursuance of the impugned First Information Report dated 28.12.2019 registered as F.I.R No. 1628/2019, U/S 409, 420 IPC at Police Station-Gomti Nagar, District-Lucknow."

¶3Learned counsel for the petitioner says that a co-accused has approached this Court in Crl. Misc. Writ Petition No.8725 of 2023 where this Court has granted interim protection by its order dated 07.12.2023.

¶4Learned A.G.A. has objected to such argument and says that the petitioner is the group President of Sign City group which was running a ponzy scheme and had duped unsuspecting investors into giving money to him on the promise that he will double the same.
