¶1Heard learned counsel for the petitioners, learned Standing Counsel for the State respondents, Shri Mohan Singh, learned counsel for Gaon Sabha and perused the record.

¶2The instant petition has been filed with the following relief:- "I. Issue a direction, to direct the opposite party no 2 i.e., Learned Additional Commissioner (Judicial), Ayodhya Mandal, Ayodhya to decide the interim application of the appeal no. 2262 of 2023 under section 331(3) Uttar Pradesh Zamidari Abolition & Land Reform Act 1950 titled as Smt. Indravati & others Versus Shambhunath & Others, Pending Since 06/10/2023, expeditiously within a reasonable time. on the basis of day by day hearing or week by week hearing after ignoring adjournments of either party to case. In the interest of justice. II. Issue a direction, to direct the opposite party no. 2 i.e., Learned Additional Commissioner (Judicial), Ayodhya Mandal, Ayodhya to decide the appeal no. 2262 of 2023 under section 331(3) Uttar Pradesh Zamidari Abolition & Land Reform Act 1950 titled as Smt. Indravati & others Versus Shambhunath & Others, Pending Since 11/10/2023, expeditiously within a reasonable time, on the basis of day by day hearing or week by week hearing after ignoring adjournments of either party to case in the interest of justice."

¶3The learned counsel appearing for the petitioners submits that the matter is pending consideration since 2023. He added that the interest of justice would subserve if this Hon'ble Court would be pleased to direct the respondent no.2 to decide the pending appeal no. 2262 of 2023 under section 331(3) Uttar Pradesh Zamidari Abolition & Land Reform Act, 1950 titled as Smt. Indravati & others Versus Shambhunath & Others alongwith interim application within a stipulated period of time as may be fixed by this Court.

¶4The learned Standing Counsel has no objection to the contention aforesaid.

¶5In view of the aforesaid innocuous prayer, the respondent no.2 i.e. Additional Commissioner (Judicial), Ayodhya Mandal, Ayodhya, is hereby directed to decide the pending appeal no. 2262 of 2023 under section 331(3) Uttar Pradesh Zamidari Abolition & Land Reform Act, 1950 titled as Smt. Indravati & others Versus Shambhunath & Others alongwith application of interim relief within a period of six months, from the date a certified copy of this order is produced before it, in accordance with law, after affording an opportunity of hearing to all the parties, if there is no legal impediment.

¶6The aforesaid order is subject to cooperation of the petitioners.
