¶1Heard learned counsel for the petitioner, learned Standing Counsel for the State respondents, Shri Pankaj Gupta, learned counsel for the Gaon Sabha and perused the record.

¶2The instant petition has been filed with the following relief:- "i. to issue a direction to the opposite party No. 1 i.e. Sub-Divisional Officer, Tehsil Lalganj, District-Pratapgarh to decide the pending Case No. 2675 of 2022 (Computerized Case No. T202202570202675) under section 116 of U.P. Revenue Code 2006 "Shyama Devi Versus Shobhawati & others" in respect of land in question i.e. Gata No. 507/0.5200 hectare situated at Village Sunderpur, Pargana-Sadar, Tehsil-Lalganj, District-Pratapgarh, since 6.7.2022, expeditiously within stipulated period as early as possible."

¶3The learned counsel appearing for the petitioner submits that the matter is pending consideration since 2022. He added that the interest of justice would subserve if this Hon'ble Court would be pleased to direct the respondent no.1 to decide the pending Case No. 2675 of 2022 (Computerized Case No. T202202570202675) under section 116 of U.P. Revenue Code 2006 "Shyama Devi Versus Shobhawati & others" in respect of land in question i.e. Gata No. 507/0.5200 hectare situated at Village Sunderpur, Pargana-Sadar, Tehsil-Lalganj, District-Pratapgarh within a stipulated period of time as may be fixed by this Court.

¶4The learned Standing Counsel has no objection to the contention aforesaid.

¶5In view of the aforesaid innocuous prayer, the respondent no.1 i.e. Sub-Divisional Officer, Tehsil Lalganj, District-Pratapgarh, is hereby directed to decide the pending Case No. 2675 of 2022 (Computerized Case No. T202202570202675) under section 116 of U.P. Revenue Code 2006 "Shyama Devi Versus Shobhawati & others" in respect of land in question i.e. Gata No. 507/0.5200 hectare situated at Village Sunderpur, Pargana-Sadar, Tehsil-Lalganj, District-Pratapgarh within a period of six months, from the date a certified copy of this order is produced before it, in accordance with law, after affording an opportunity of hearing to all the parties, if there is no legal impediment.

¶6The aforesaid order is subject to cooperation of the petitioner.
