¶1Heard Sri Siddharth Niranjan, learned counsel for the applicant and Sri Brijesh Kumar Dwivedi, learned AGA for the State-respondents.

¶2The present writ petition has been preferred with the prayer to quash the order dated 12.09.2024 passed by the learned Special Judge, 138 N.I. Act, Kanpur Nagar issuing proclamation under 82 and 83 and non-bailable warrant and recovery warrant issued by the learned Special Judge, 138 N.I. Act, Kanpur Nagar.

¶3At the very outset, learned counsel for the applicant submits that he does not want to press this application as he has already challenged the appellate order by which conviction under Section 138 N.I. Act has been affirmed in Criminal Revision (Defective) No.1127 of 2023 and he will pursue the same.
