The instant application under Section 482 Cr.P.C. has been filed for setting aside the criminal proceedings of Complaint Case No. 29834 of 2022 (M/S National Fertilizers Ltd. Vs. Dilip Kumar Srivastava) pending in the court of Additional Court No. 5, Lucknow under Section 138 of Negotiable Instrument Act as well as the summoning order dated 25.08.2022 and the bailable warrants dated 04.01.2024. A perusal of the F.I.R. and the material in the record a prima facie case is disclosed against the applicant. The applicant has raised certain triable issues before this Court which can only be decided after a full fledged trial. The application U/S 482 is dismissed.
