Court No. - 29 Case :- APPLICATION U/S 482 No. - 2559 of 2024 Applicant :- Anil Alias Anil Kumar And 3 Others Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. Civil Secrt. Lko. And 2 Others Counsel for Applicant :- Vishal Singh Counsel for Opposite Party :- G.A.,Lav Singh,Raj Singh Hon'ble Ajay Bhanot,J. Heard Shri Vishal Singh, learned counsel for the applicant, Shri Raj Singh, learned counsel and Shri Lav Singh, learned counsel for the opposite party Nos.2 & 3 and Shri Girjesh Kumar Dwivedi, learned A.G.A. for the State. The application U/S 482 Cr.P.C. has been filed by the applicant to quash the proceedings of the Criminal Case No.7756 of 2021, Case Crime No.0415 of 2019 under Sections 323, 504, 506, 325 IPC, Police Station-P.G.I., District-Lucknow (State of Uttar Pradesh v. Anil and others) charge-sheet dated 23.05.2019 and summoning order dated 08.02.2021. Shri Vishal Singh, learned counsel for the applicant and Shri Raj Singh, learned counsel and Shri Lav Singh, learned counsel for the opposite party Nos.2 & 3 submit that the dispute between the parties has been amicably resolved. The compromise has been reduced to writing and duly executed by the parties. The compromise has also been verified by the learned trial court in terms of the order dated 16.01.2024. The aforesaid facts could not be disputed by the learned A.G.A. and borne out from the records. Continuance of criminal proceedings in these circumstances will be an exercise in futility as there is no possibility of conviction of the applicants. Further the proceedings will entail wastage of precious judicial time and create bad blood between the parties. No useful purpose would be served by keeping the application pending. In the wake of the aforesaid, the impugned Criminal Case No.7756 of 2021, Case Crime No.0415 of 2019 under Sections 323, 504, 506, 325 IPC, Police Station-P.G.I., District-Lucknow (State of Uttar Pradesh v. Anil and others), charge-sheet dated 23.05.2019 and summoning order dated 08.02.2021 are quashed. The Application U/S 482 Cr.P.C. is allowed.
