Court No. - 29 Case :- APPLICATION U/S 482 No. - 2591 of 2024 Applicant :- Rahul Raj Chaudhary Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. And Another Counsel for Applicant :- Samrat Gupta Counsel for Opposite Party :- G.A. Hon'ble Ajay Bhanot,J. Learned AGA, contends that from a perusal of the F.I.R. and evidences collected during the investigation prima facie offence is disclosed against the applicant. The FIR asserts that the applicant had embezzled funds from the shop of the opposite party no. 2. Faced with this, Shri Samrat Gupta, learned counsel for the applicant does not press the prayer sought in the applicant. He recasts his relief and submits that the applicant may be permitted to apply for bail and also to file a discharge application through counsel before the learned trial court. It is always open to the applicant to invoke his remedy available to him in law. However, in case the applicant invokes such remedy, the competent court shall decide the same expeditiously and in accordance with law. The Application U/S 482 is disposed of.
