Judgment
Court No. - 29 Case :- APPLICATION U/S 482 No. - 2568 of 2024 Applicant :- Aryan Singh And 3 Others Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. And Another Counsel for Applicant :- Deepak Kumar Tiwari Counsel for Opposite Party :- G.A. Hon'ble Ajay Bhanot,J. Heard Sri Deepak Kumar Tiwari, learned counsel for the applicant and Sri Ram Sufal, learned counsel for the opposite party No.2 and learned AGA for the State. Learned counsels for the parties contend that the proceedings arise out of a matrimonial dispute. The parties have amicably resolved their differences and a compromise has been reduced to writing. The learned trial court has verified the compromise by order dated
01.01.2024 which is appended as Annexure-5. The aforesaid facts could not be disputed by the learned A.G.A. and borne out from the records. Continuance of criminal proceedings in these circumstances will be an exercise in futility as there is no possibility of conviction of the applicants. Further the proceedings will entail wastage of precious judicial time and create bad blood between the parties. No useful purpose would be served by keeping the application pending. In wake of the aforesaid, the proceedings of Criminal Case No. 150851 of 2023 (State Vs. Aryan Singh and others) arising out of Case Crime No. 0337 of 2023 under Sections 323, 504, 506 IPC, Police Station Ashiyana District Lucknow pending in the court of Chief Judicial Magistrate-Vth, Lucknow are quashed. The Application U/S 482 is allowed. Order Date :- 18.3.2024 Pravin High Court of Judicature at Allahabad, Lucknow Bench
