Judgment

Court No. - 29 Case :- APPLICATION U/S 482 No. - 2650 of 2024 Applicant :- Manu Pal @ Ritik Pal And 2 Others Opposite Party :- State Of U.P. Thru. Addil. Chief Secy. Deptt. Home Lko. And Another Counsel for Applicant :- Gulam Mustafa Counsel for Opposite Party :- G.A. Hon'ble Ajay Bhanot,J. Heard Sri Gulam Mustafa, learned counsel for the applicant and Sri Ravendra Pratap Singh Chauhan, learned counsel holding brief of Sri Lokendra Kumar Gupta, learned counsel for the opposite party No. 2 and learned AGA for the State. Learned counsels for the parties contend that the proceedings arise out of a matrimonial dispute. The parties have amicably resolved their differences and a compromise has been reduced to writing. The learned trial court has verified the compromise by order dated

05.12.2023 which is appended as Annexure-7. The aforesaid facts could not be disputed by the learned A.G.A. and borne out from the records. Continuance of criminal proceedings in these circumstances will be an exercise in futility as there is no possibility of conviction of the applicants. Further the proceedings will entail wastage of precious judicial time and create bad blood between the parties. No useful purpose would be served by keeping the application pending. In wake of the aforesaid, the proceedings of Criminal Case No. 186 of 2022 arising out of Case Crime No. 485 of 2021 under Sections 354A, 354B, 323, 504, 506, 452, 427 IPC, Police Station Para, District Lucknow pending in the court of Civil Judge (S.D.), Court no. 20, Lucknow, are quashed. The Application U/S 482 is allowed. Order Date :- 19.3.2024 Pravin High Court of Judicature at Allahabad, Lucknow Bench
