Court No. - 29 Case :- APPLICATION U/S 482 No. - 2697 of 2024 Applicant :- Abhishek Gupta And Another Opposite Party :- State Of U.P. Thru. Prin. Secy. Deptt. Home Civil Sectt. Lko And Another Counsel for Applicant :- Braj Nandan Yadav Counsel for Opposite Party :- G.A. Hon'ble Ajay Bhanot,J. Shri Jaskaran Lal Maurya, Advocate has filed his Vakalatnama on behalf of opposite party No.2, which is taken on record. Heard Shri Braj Nandan Yadav, learned counsel for the applicant, Shri Jaskaran Lal Maurya, learned counsel for the opposite party No.2 and learned A.G.A. for the State. The application U/S 482 Cr.P.C. has been filed by the applicants to quash the proceedings of the Criminal Case No.4926 of 2016, Case Crime No.129 of 2014 under Sections 323, 504, 342 IPC, Police Station-Alambagh, District-Lucknow (State of Uttar Pradesh v. Abhishek Gupta and another) charge-sheet dated

11.07.2014 and summoning order dated 25.01.2016. Learned counsel for the parties submit that the dispute between the parties has been amicably resolved. The compromise has been reduced to writing and duly executed by the parties. The compromise has also been verified by the learned trial court in terms of the order dated 20.10.2023. The aforesaid facts could not be disputed by the learned A.G.A. and borne out from the records. Continuance of criminal proceedings in these circumstances will be an exercise in futility as there is no possibility of conviction of the applicants. Further the proceedings will entail wastage of precious judicial time and create bad blood between the parties. No useful purpose would be served by keeping the application pending. In the wake of the aforesaid, the impugned Criminal Case No.4926 of 2016, Case Crime No.129 of 2014 under Sections 323, 504, 342 IPC, Police Station-Alambagh, District-Lucknow (State of Uttar Pradesh v. Abhishek Gupta and another) charge-sheet dated

11.07.2014 and summoning order dated 25.01.2016 are quashed. The Application U/S 482 Cr.P.C. is allowed. Order Date :- 19.3.2024 Ashutosh High Court of Judicature at Allahabad, Lucknow Bench
