Prosecution case set out in the FIR is that the accused persons some of whom are named and others were identified as unnamed inflicted grievous injuries to the victim. Learned AGA, contends that from a perusal of the F.I.R. and the material gathered during the course of investigation prima facie offence is disclosed against the applicant. Faced with this, Shri Aseem Kumar Pandey, learned counsel for the applicant does not press the prayer sought in the applicant. He recasts his relief and submits that the applicant may be permitted to apply for bail and also to file a discharge application through counsel before the learned trial court.
