By means of instant appeal preferred under Section 14-A(1) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (in short "SC/ST Act"), the appellant has assailed the order dated 22.01.2024 passed by the Special Judge SC/ST Act, Balrampur (in short "trial court"), whereby, the trial court rejected the protest petition filed by the appellant against the final report dated 09.11.2020, in Criminal Case No. 134 of 2020 (Achhay Kumar vs. Noor Mohammadi and others), arising out of Case Crime No. 89 of 2020, under Sections-147, 323, 504, 506, 392 IPC and Sections-3(1)(Dha), 3(2)(v) SC/ST Act, Police Station-Kotwali Dehat, District-Balrampur. The appellant has also prayed that Investigating Officer concerned be directed to re-investigate the Case Crime No. 89 of 2020. Brief facts of the case are to the effect that making certain allegations against some persons, the appellant had approached this Court by means of a petition i.e. Misc. Bench No. 7140 of 2020 (Akshay Kumar vs. State of U.P. and others), which was disposed of by this Court vide order dated 06.03.2020, after considering the observations made by the Hon'ble Apex Court in the judgment passed in the case of Lalita Kumari vs. Government of Uttar Pradesh and others reported in (2014) 2 SCC 1, with a direction to the petitioner/appellant to approach the opposite party No. 2/ Superintendent of Police, District-Balrampur for redressal of his grievances. The order dated 06.03.2020 on reproduction reads as under:- "Heard learned counsel for the petitioner and learned Additional Government Advocate for the respondents. Learned counsel for the petitioner submits that petitioner has approached opposite party no.2/ Superintendent of Police, District-Balrampur for lodging the F.I.R., however no heed has been paid in the matter in question. So, the petitioner has approached this Court with the following main relief:- "Issue a writ, order or direction in the nature of mandamus thereby commanding and directing the opposite parties no.2 and 3 to take appropriate action against the opposite party no.4 to 13 on the complaint of the petitioner dated 04.01.2020,

31.01.2020 and 27.01.2020 respectively to this writ petition, in the interest of justice." After hearing learned counsel for the parties and going through the record as well as taking into consideration the law laid down by Hon'ble Apex Court in the case of Lalita Kumari Vs. Government of Uttar Pradesh and others reported in (2014) 2 SCC 1, we hereby direct the petitioner to approach opposite party no.2/ Superintendent of Police, District-Balrampur in respect to the grievances which he has raised in the present writ petition and thereafter opposite party no.2 shall take appropriate steps in the matter in question as per law laid down by Hon'ble Apex Court in the case of Lalita Kumari (supra). With the above observations, the writ petition is disposed of." It appears that after order passed by this Court dated 06.03.2020, an FIR was lodged on 21.03.2020 at about 14.35 hours against 9 persons, who are respondent Nos. 2 to 10 herein, namely Smt. Noor Mohammadi, Maroof, Rizwan, Farooq, Mairaj, Rafi, Iliyas, Haieil and Ayaas. A perusal of the aforesaid FIR indicates that the appellant preferred an application dated 07.01.2020 before the concerned officer on tehsil diwas for removal of illegal encroachment over Gaon Sabha land situated at village-Narainpur, P.S.- Kotwali Dehat, District-Balrampur and thereafter on

24.01.2020, the concerned Lekhpal and Kanoongo reached the land in issue and measurement was carried out there by the revenue officials and during measurement, the appellant made video clip due to which altercation took place between the appellant and accused, respondent Nos. 2 to 10 herein, and the accused/respondent Nos. 2 to 10, assaulted the appellant and also snatched his mobile phone and golden ring. Further allegation in this FIR against the accused/respondent Nos. 2 to 10 is to the effect that they used abusive language and made casteist remarks against the appellant. After lodging of FIR, the investigating officer carried out the investigation and submitted final report, against which, the appellant filed the protest petition, which was dismissed by trial court vide order impugned dated 22.01.2024. बलरतमपकरसवलकतरककजततलहह।पततवललवनयमतनकसतरदतलखलअवभलकखतगतरहल।" Thus, taking note of the aforesaid, this Court finds that the appellant failed to make out the case before the trial court and trial court, after considering the facts that (i) despite making allegations of assault against the respondent Nos. 2 to 10, herein, the appellant failed to indicate and prove the fact that he was examined and treated by doctor and (ii) the Lekhpal and Revenue Inspector found that there is no encroachment over Gaon Sabha land as also the statements of independents witnesses namely Rakesh Kumar (real brother of the appellant), Gopal Ji Srivastava (Lekhpal), Babban Singh (Revenue Inspector), Dukharan Gupta, Sadhuram and Vanshraj, according to whom, no such incident, as alleged in the FIR or protest petition, occurred on 24.01.2020, rightly rejected the protest petition of the appellant vide impugned order dated 22.01.2024. It is also for the reason that the appellant, to the view of this Court, was using the state machinery just to create pressure on the revenue authorities, which is nothing but an abuse of process of law.
