Judgment

Court No. - 31 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 503 of 2024 Applicant :- Ram Rani Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. And Another Counsel for Applicant :- Raghvendra Singh Counsel for Opposite Party :- G.A. Hon'ble Mrs. Sadhna Rani (Thakur),J. Heard learned counsel for the applicant, learned A.G.A. both through video conferencing from Allahabad and perused the record. The accused-applicant is involved in Case Crime No. 347 of 2023, under Sections 419, 420 I.P.C., Police Station Maholi, District-Sitapur. It is submitted by the learned counsel for the applicant that the applicant has no role in the incident. The property was transferred through sale deed in her name by one Ram Pyari. Her husband Rakesh and one Pramod were the witnesses of the sale deed. The name of Ram Pyari was mutated in revenue records. Ram Pyari and Rakesh have been granted bail. The applicant has apprehension of her arrest in the matter, hence, the prayer for anticipatory bail is made. Learned A.G.A. opposed the prayer and submitted that both Ram Pyari and Rakesh were granted regular bail while the present applicant is seeking for anticipatory bail. The parity claimed is wrong. From the perusal of the record, it is found that the allegation in the FIR is that Ram Pyari got her name fraudulently mutated in revenue records showing herself to be the wife of Kishori Lal while she is the wife of Balakram and from this Ram Pyari, the present applicant Ram Rani is said to have got executed a sale deed in her favour. The title of Ram Pyari is under cloud. Perusing the record, considering the facts and circumstances of the case, the nature of allegations, arguments advanced by the learned counsel for the parties and without expressing any opinion on the merit of the case, I do not find it to be a fit case of bail. The anticipatory bail application of the applicant is rejected. Order Date :- 26.4.2024 Gss High Court of Judicature at Allahabad, Lucknow Bench
