¶1Heard Sri Ashok Kumar, Advocate for the petitioner and the Standing counsel for the respondents.

¶2By means of the present writ petition the petitioner has prayed for a direction to opposite party No.4 i.e. Tehsildar, Tehsil Nighasan, District Lakhimpur Kheri to issue caste certificate. It has been submitted by learned counsel for the petitioner that the petitioner has repeatedly given applications in this regard i.e. on 15.4.2023, 5.12.2023, 16.4.2024, 1.5.2024 and 22.5.2024 but despite the said applications no action has been taken by the respondents and consequently aforesaid prayer has been made.

¶3Learned Standing counsel has opposed the writ petition stating that in paragraph 3 itself it has been stated that the applications preferred by the petitioner have been rejected. But the rejection order has not been annexed and only a downloaded copy has been annexed which merely indicates that his application has been rejected on 1.6.2024. He has further submitted that the petitioner has efficacious and alternate remedy of filing appeal before District Level Caste Scrutiny Committee which is headed by District Magistrate and in case his grievance is not redressed by the aforesaid committee he has remedy before the Regional Level Caste Scrutiny Committee as provided in the Government Order dated 28th February, 2011.

¶4At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw this petition to pursue the remedy as provided in the aforesaid Government Order.

¶5Learned Standing counsel does not oppose the prayer made by the petitioner.

¶6Accordingly, the petition is dismissed as not pressed with aforesaid liberty. (Arun Kumar Singh Deshwal, J.) (Alok Mathur, J.) Order Date :- 25.6.2024 RKM. High Court of Judicature at Allahabad, Lucknow Bench
