¶1Sri Mahesh Kr. Yadav, learned counsel has filed vakalatnama on behalf of respondent No.3, which is taken on record.
¶2Heard Sri Manish Arora, learned counsel for the petitioner, learned Standing Counsel on behalf of respondents No. 1 & 2 and Sri Mahesh Kr. Yadav, learned counsel for respondent No.3.
¶3At the very outset, learned counsel for respondent No.3 has informed this Court that the claim was filed by the petitioner before the committee, headed by the District Magistrate, showing herself as the sole legal heir of the deceased being his wife. He submits that, in fact, the petitioner is mother of the deceased and the deceased was survived by his wife and two children who were not shown in the claim as the legal heirs of the deceased and according to the said concealment, the claim was allowed in favour of the petitioner.
¶4On the said objection, being raised by the respondent, counsel for the petitioner prays for and is permitted to withdraw the writ petition as there are certain typographical errors in the writ petition.
¶5Accordingly, the writ petition is dismissed as not pressed with liberty to the petitioner to file afresh. (Arun Kumar Singh Deshwal,J) (Alok Mathur,J.) Order Date :- 27.6.2024 Vandana High Court of Judicature at Allahabad, Lucknow Bench
