The prayer made in the instant petition is for commanding the respondent Nos. 1 and 2 to take legal action against respondent No. 3 and stop illegal encroachment allegedly made over Gata No. 1190g area 0.0630 hectare and 1370kh area 0.3240, situated in Village Narai, Tehsil Kunda, District Pratapgarh. A perusal of averments made in the writ petition reveals that the dispute is between the petitioner and respondent No. 3 i.e. two private individuals, in relation to title and possession over the immovable property. We are not inclined to examine the said controversy in exercise of writ jurisdiction. It is left open to the petitioner to avail the remedies provided under common law.
