Judgment

Court No. - 7 Case :- WRIT - C No. - 842 of 2024 Petitioner :- Ram Bilas Gupta Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko. And 4 Others Counsel for Petitioner :- Manish Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Manoj Kumar Gupta,Acting Chief Justice Hon'ble Saurabh Lavania,J. The prayer made in the instant petition is for restraining the respondents from opening Police Chowki over land of Arazi/Gata No. 123 (New Arazi/Gata No. 91) area 0.210 hectare, situated at Village Indaipur, Pargana Bidhar, Tehsil Aalapur, District Ambedkar Nagar and further to direct the parties to maintain status-quo during the pendency of the restoration application of the petitioner before SDM, Tehsil Aalapur, District Ambedkar Nagar. The petitioner claims Sirdari rights over the aforesaid land, however, it is not disputed that in CH Form 43 and 45 his name is not entered as Sirdar. The notification under Section 52 of the U.P. Consolidation of Holdings Act was issued long back. The petitioner has filed an application for correction of revenue records before respondent no.4. The said application was dismissed for want of prosecution. The petitioner has now applied for restoration and the application filed in this regard is pending. In the aforesaid background, the reliefs as noted above, have been prayed for. As on date, the name of petitioner does not find place in revenue records and his restoration application is pending before respondent no.4, therefore, we find no good ground to grant the reliefs as prayed for in the instant petition. It is left open to the petitioner to seek appropriate reliefs in the pending proceedings or to institute independent proceedings before appropriate court/authority, if so advised. The petition stands disposed of accordingly. . . (Saurabh Lavania,J.) (Manoj Kumar Gupta, A.C.J.) Order Date :- 29.1.2024/Jyoti/- High Court of Judicature at Allahabad, Lucknow Bench
