¶1Counter affidavit filed today is taken on record.

¶2The prayer made in the instant petition is for a direction to the respondents to refund the earnest money, security amount and first installment of royalty deposited by him in pursuance of letter of intent dated 22.12.2022 alongwith interest at the rate of 18% per annum from the date of deposit until it is refunded.

¶3Learned State counsel has filed a counter affidavit annexing therewith an affidavit of the petitioner, in which he has agreed to accept the principal amount without any interest. Learned State counsel submits that on the basis of aforesaid affidavit the entire royalty amount and earnest money totaling Rs. 23,57,928/- was returned to the petitioner on 12.01.2024.

¶4Learned counsel for petitioner admits the said fact.

¶5The cause therefore, does not survive.
