Judgment

Court No. - 7 Case :- WRIT - C No. - 900 of 2024 Petitioner :- Vimla @ Vimla Devi Respondent :- Union Of India Thru. Secy. Ministry Road Transport Highway Govt. India And 3 Others Counsel for Petitioner :- Hanumant Lal Yadav Counsel for Respondent :- A.S.G.I.,C.S.C. Hon'ble Manoj Kumar Gupta,Acting Chief Justice Hon'ble Saurabh Lavania,J.

¶1Heard Shri Hanumant Lal Yadav, learned counsel for the petitioner, Shri Krishna Lal Yadav, learned counsel for NHAI and Shri H.K. Bhatt, Additional Chief Standing Counsel for the State-respondents.

¶2The petitioner alleges that the respondents have taken over possession of excess land than what was acquired under the provisions of the National Highways Act, 1956. The compensation for the excess land has not been paid to the petitioner.

¶3The petitioner is placing reliance on a representation dated 23.12.2023 made in this behalf to the District Magistrate.

¶4We have gone through the said representation. It does not mention how much excess area was taken over by the respondents. The representation is absolutely vague.

¶5We are, therefore, not ready to accept the claim of the petitioner.

¶6At this stage, learned counsel for the petitioner states that it be left open to the petitioner to apply for demarcation of his remaining land.

¶7Having regard to the said submission, we dispose of the instant petition with liberty to the petitioner to apply for demarcation of the area, which was not acquired by the respondents in pursuance of the notifications under the National Highways Act, 1956.
