Chief Justice's Court Case :- SPECIAL APPEAL No. - 291 of 2024 Appellant :- Sharad Chandra Pandey Respondent :- State of U.P. thru. its Addl. Chief Secy./ Prin. Secy. Deptt. of Rural Dev. Lko. and 3 others Counsel for Appellant :- Abhineet Jaiswal Counsel for Respondent :- V.P. Nag, S.C. Hon'ble Arun Bhansali,Chief Justice Hon'ble Jaspreet Singh,J.
¶1This appeal is directed against order dated 28.11.2024 passed by learned Single Judge in Writ-A No.11354 of 2024, whereby the writ petition filed by the petitioner/appellant, aggrieved of the order of transfer, has been dismissed.
¶2The appellant approached this Court, aggrieved of the order of transfer, which petition was decided requiring the respondents to decide a fresh representation, to be filed by the appellant. The representation was rejected, feeling aggrieved, fresh writ petition was filed.
¶3Learned Single Judge, after hearing the parties, came to the conclusion that the appellant has stayed at District Unnao for over 25 years and on promotion, has been transferred and, therefore, there was apparently no reason to interfere with the order impugned and dismissed the petition.
¶4Learned counsel for the appellant reiterated the submissions, as made before the learned Single Judge. However, it is not denied that the appellant has stayed at District Unnao for 25 years and has been transferred for the first time out of the district, on promotion.
¶5In the glaring circumstances, as noticed, wherein the appellant has stayed at the present place of posting for over 25 years, we do not find any reason to interfere with the order impugned passed by learned Single Judge.
¶6The appeal is, therefore, dismissed. Order Date :- 18.12.2024 SL/Mukesh (Jaspreet Singh, J) (Arun Bhansali, CJ) High Court of Judicature at Allahabad, Lucknow Bench
