Heard learned counsel for petitioner, learned State Counsel for opposite parties 1 to 3 and 5 and Mr. Dilip Kumar Pandey learned counsel for opposite party No.4. In view of order being passed notice to opposite party No.6 stands dispensed with. Petition has been filed challenging order dated 9th October, 2023 whereby demarcation of gata No. 628 has been directed. Learned counsel for petitioner submits that petitioner is a tenure holder over gata No. 628-Ga which will also be effected by demarcation order but the petitioner was not made a party to the proceedings and came to know about aforesaid order subsequently. Learned counsel for opposite parties however have submitted that petitioner can very well file an application for recall in case he is aggrieved by the said order. In view of aforesaid submissions, liberty is granted to petitioners to seek recall of the order dated 9th October, 2023 alongwith application for condonation of delay before the authority concerned which shall be considered and decided expeditiously. Liberty is also granted to the petitioner to file an application for interim relief which may be considered in case delay is condoned. With the aforesaid directions, the petition stands disposed of.
