And 7 Others Counsel for Petitioner :- Ashutosh Kumar Singh,Hari Om Pandey Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Rajan Roy, J. Hon'ble Brij Raj Singh, J.
¶1Heard learned counsel for the petitioners, learned Standing Counsel for State-opposite parties no.1 to 7 and Sri Pankaj Gupta, learned counsel appearing for opposite party no.8.
¶2The petitioners allege their dispossession from Gata Nos.24448, 2450 and 2479 situated at Village Badgharpurva, Hardatta Nagar, Tehsil Jamunaha, District Shrawasti. However, on being asked, counsel for the petitioners fairly submitted that petitioners are not recorded as tenure holders in respect of the said gatas though they claim possession over the same for quite some time. This is not an issue which can be adjudicated under Article 226 of the Constitution of India. If the petitioners claim their rights under Section 67A of the U.P. Revenue Code, 2006, then they may pursue the matter before the authority or court where such proceedings may have been initiated, but we cannot enter into such issues of possession etc. under Article 226 of the Constitution of India.
