¶1Heard the counsel for the petitioner and the counsel for the respondent bank.

¶2The present petition has been filed seeking to challenge the auction notice issued by the respondent bank for recovery of the outstanding dues.

¶3The counsel for the respondent - bank based upon the instructions states that an amount of Rs.1,04,288/- is due and payable by the petitioner on 31.12.2024.

¶4The counsel for the petitioner wants sometime to repay the said amount as he has a poor farmer.

¶5Considering the said submissions, the present petition is disposed off providing that the recovery issued against the petitioner shall not be affected subject to the petitioner depositing an amount of Rs.5,000/- on or before 31.12.2024. The balance amount of about of rupees one lac shall be paid by the petitioner in four equal installment of Rs.25000/-. The first of which will be payable by 31.03.2025, the second installment by 30.06.2025, the third installment by 30.09.2025 and the last installment by 31.12.2025 which includes the interest.

¶6In the event of failure to deposit any of the installment, the respondent bank would be at liberty to initiate and conclude the recovery in accordance with law. Order Date :- 19.12.2024 VNP/- High Court of Judicature at Allahabad, Lucknow Bench
