¶1Heard Shri Ashish Jaiswal, Advocate holding brief of Shri Surendra Pal Singh, learned counsel for the petitioner and Shri Rinju Verma, learned counsel for the respondent(s).

¶2The issue raised in the present writ petition is squarely covered by the judgment of this Court passed in Matters Under Article 227 No. 5766 of 2023, The New India Assurance Co. Ltd. vs. Permanent Lok Adalat and 3 Others, as well as the judgment passed in Writ C No.7308 of 2024, Oriental Insurance Company vs. Ram Swaroop and 4 Others.

¶3Considering and following the aforesaid judgments, the writ petition is partly allowed. The amount awarded is modified and reduced to the extent that in case the amount awarded along with the penalty is paid within two months, the liability of interest shall not be saddled upon the petitioner. Any amount paid and deposited before this Court during the pendency of the writ petition shall be relegated to the Permanent Lok Adalat for being paid to the claimant in accordance with law.
