In view of the order proposed to be passed issuance of notice to opposite party no.2 shall stand dispensed with. Present petition has been filed seeking a direction to the concerned authority for expeditious disposal of the recall application filed by the petitioner in Suit No.12897/2024 filed under Section – 209 (h) of the U.P. Revenue Code, 2006 [Ashutosh Srivastava vs. Dalveer Singh]. However, from a perusal of the order sheet it appears that on the aforesaid restoration application notices have been issued on 19.11.2024. Service report does not appear to have been placed on record as yet. Considering aforesaid facts no specific time frame can be directed for disposal of the restoration application. However, opposite party no.1 is directed to decide the aforesaid recall application expeditiously without granting undue adjournment to either parties.
