Judgment

Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1113 of 2024 Petitioner :- Suresh Kumar Dwivedi Respondent :- State Of U.P. Thru. Addl. Chief Secy. Of Rural Development Deptt. Lko And 9 Others Counsel for Petitioner :- Ravindra Shukla Counsel for Respondent :- C.S.C.,Amarendra Pratap Singh,Mohan Singh Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.

¶1Heard Sri Ravindra Shukla, the learned counsel for the petitioner, the learned Additional Chief Standing Counsel appearing on behalf of the State, Sri Amrendra Pratap Singh, the learned counsel appearing on behalf of the opposite party no.2, Sri Mohan Singh, the learned counsel for the Gaon Sabha and perused the records.

¶2A complaint is already pending before the Lok Ayukt. Institution of the present petition in public interest simultaneously before this court is nothing but an abuse of the process of law, unless the petitioner has a genuine grievance on the touchstone of inaction, as is not the case at hand.

¶3The learned counsel appearing for the Lok Ayukt has informed that a complaint has already been registered and the matter is in progress.

¶4In this view of the matter, the writ petition is declined to be entertained and the same is dismissed without prejudice to the consideration of the complaint by the Lok Ayukt. It however shall not suggest that we have made any observation on the merits of the case or on the maintainability of the complaint. [Subhash Vidyarthi, J.] [A.R. Masoodi, J.] Order Date :- 20.12.2024 Ram. High Court of Judicature at Allahabad, Lucknow Bench
