Judgment

Court No. - 6 Case :- WRIT - A No. - 12507 of 2024 Petitioner :- Akanksha Pno. 212831414 Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Home And 3 Others Counsel for Petitioner :- M.P. Raju Counsel for Respondent :- C.S.C. Hon'ble Alok Mathur,J.

¶1Heard Sri M.P. Raju, learned counsel for the petitioner as well as learned Standing Counsel for the respondents.

¶2Prayer made by the petitioner in the present writ petition is for mandamus to the respondents to consider her transfer to District Agra where her husband is posed as Technician Army Base Workshop, District – Agra.

¶3It has been submitted by learned counsel for the petitioner that petitioner is working as lady Sub Inspector in Civil Police at Police Station - Kotwali, District - Kannauj and she was married to one Sri Ravindra Kumar Singh and since then they both are living separately at their place of posting and also that the petitioner is sick and her treatment is going on at Agra and that in the family at Agra there is old father-in-law who needs care and in the aforesaid circumstances she has made representation to respondent no. 2 to consider her case for transfer on compassionate grounds to Agra.

¶4Learned Standing Counsel on the basis of instructions has informed this Court that by means of circular dated 17.10.2024, benefit of couple posting has been restricted only to the persons who are appointed prior to 2017 and it has been specifically stated that the said benefit will not be given to the Police Personnels appointed after 2017. A copy of circular dated

17.10.2024 is produced before this Court and on perusal of the same, this Court finds that no reasons have been given for taken such a stand and reason for discriminating Police Personnel who are appointed prior to 2017 and post 2017, could not be understood.

¶5On the face of it the circular dated 17.10.2024 seems to be discriminatory and arbitrary. In any view of the matter let representation of the petitioner in this regard as contained in Annexure-5 to the writ petition dated 26.09.2024, be considered and decide by respondent no. 2 - Additional Director General of Police (Establishment), Police Headquarter, Lucknow, expeditiously, say within six weeks from the date of production of certified copy of this order, in accordance with law, ignoring circular dated 17.10.2024. Let the order so passed be communicated to the petitioner with expedition.

¶6With above directions the writ petition stands disposed of. Order Date :- 20.12.2024 A. Verma (Alok Mathur, J.) High Court of Judicature at Allahabad, Lucknow Bench
