The present petition has been filed with the following prayer: "to Issue a writ, order or direction in nature of MANDAMUS commanding and directing to the opposite party no. 1 to 4 more specifically opposite party No. 2 to 4 to remove illegal encroachment done by the opposite party No. 5 to 11 over the Pond Gata No. 639 situated at Village Gohila, Pargana & Tehsil Tanda, District Ambedkar Nagar within the stipulated time as this Hon'ble court deems just and proper." Learned Standing Counsel, based upon the instructions, states that the proceeding under Section 67 were already concluded for which an application for recall of order has been filed which is listed for hearing on 09 January, 2025. Considering the aforesaid submission, the present petition is disposed of with direction the trial court to conclude the hearing on the application for recall of order filed by the petitioner, in accordance with law, without giving unnecessary adjournment to any of the parties, within a period of two months from the date of production of certified copy of this order.
