¶1The instant petition was filed in public interest raising grievance regarding opening of liquor shops within 100 meters from residential buildings and other establishments contrary to the provisions of U.P. Number and Location of Excise Shops (Fourth Amendment) Rules, 2008.

¶2Specific grievance was raised in respect of opening of a Model Wine Shop in front of residential House No. D-2045, Indira Nagar, Lucknow.

¶3In November, 2022, an affidavit has been filed by the Executive Engineer, U.P. Awas Evam Vikas Parishad stating that the Model Shop is no more operational from House No. D-2045, Indira Nagar, Lucknow.

¶4Learned Standing Counsel appearing for State-respondents states that various affidavits have been filed to show that State-respondents are ensuring strict compliance of the restrictions stipulated under the existing Rules.

¶5None is present for the petitioner to oppose the aforesaid stand of the respondents.

¶6Having regard to the same, we are not inclined to proceed any further in the instant matter.
