Court No. - 7 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 6253 of 2015 Petitioner :- Guru Prasad Respondent :- State Of U.P.Thru. Secy.Revenue Deptt. And 17 Ors. Counsel for Petitioner :- Rakesh Pratap Singh Counsel for Respondent :- C.S.C.,Anand Mani Tripathi,Karuna Shanker Rastogi,Raj Narain Pandey,Ram Kishor,T.N.Yadav Hon'ble Manoj Kumar Gupta,Acting Chief Justice Hon'ble Saurabh Lavania,J.

¶1The prayer made in the instant petition filed in public interest is for a direction to respondent Nos.1 to 4 to immediately resume possession over Gaon Sabha land, which is alleged to be in illegal possession of respondent Nos. 5 to 18.

¶2Learned counsel for the petitioner states that private respondents have alienated the property and their transferees are now in possession.

¶3The stand taken in the counter affidavit is that the proceedings under Section 38(5) of the U.P. Revenue Code, 2006 have already been initiated against the encroachers. As soon as the proceedings are concluded action will be taken accordingly.

¶4Therefore, in our opinion, no further direction is required to be issued in the instant matter except that the proceedings, which are pending, be taken to its logical conclusion as expeditiously as possible.

¶5The petition is disposed of. (Saurabh Lavania, J.) (Manoj Kumar Gupta, A.C.J.) Order Date :- 30.1.2024 Vinay/- High Court of Judicature at Allahabad, Lucknow Bench
