ORDER

03.10.2024 Heard Ms T Som, learned counsel for the petitioner, Rushikesh Kisan Shinde, who has filed this application under Section 483 of the BNSS, 2023, with prayer for bail as he is behind bars since 25.09.2024, in connection with Pathshala PS Case No. 89/2024, under Section 304 of the BNS, 2023 Page No.# 2/3

¶2Heard Mr R R Kaushik, learned Additional Public Prosecutor for the State of Assam.

¶3There was an instance of chain snatching in Milanpur area of Patacharkuchi, where two miscreants were apprehended. In that case, the petitioner has been forwarded.

¶4It is submitted on behalf of the petitioner that the petitioner has a centre for testing gold and silver and he is a businessman from Maharashtra. The petitioner has been shown as arrested in connection with this case immediately after he was granted bail in connection with Pathshala PS Case No. 88/2024, arising out of a similar incident of chain snatching. The petitioner was granted bail on 27.09.2024, in Bail Application No. 2858 of 2024.

¶5I have considered the submissions at the Bar with circumspection.

¶6The petitioner has pledged to cooperate with the remaining part of investigation.

¶7Considering all aspects, the petitioner is enlarged on bail of Rs. 30,000/-(Rupees Thirty Thousand Only), with two local sureties of like amount, one being a Government servant, to the satisfaction of learned CJM, Bajali, under the conditions that-

i) the petitioner shall appear before the IO on every fortnight, till completion,

ii) the petitioner shall refrain from such activities with which he is alleged, and

iii) the petitioner shall not leave the jurisdiction of the Court, without prior permission. Page No.# 3/3

7.1. On breach of any of the bail conditions, bail order shall automatically stand cancelled.

¶8Bail Application stands disposed of.
