Babulal Narzary v. The State of Assam

ORDER Date : 18-11-2024 Heard Mr. S. Nawaz, learned counsel for the petitioner namely Babulal Narzary, who has filed this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for pre-arrest bail as he is Page No.# 2/2 apprehending arrest in connection with Dhubri P.S. Case No.268/2024 under Sections 420/408/466/468/471 IPC, 1860.

¶2Heard Mr. B. Sarma, learned Additional Public Prosecutor, Assam for the respondent State.

¶3Earlier the petitioner was already arrested in connection with a similar offence registered as Bongaigaon P.S. Case No.296/2024 under Sections 61(2)

(a)/336(3)/316(2)/340(2)/316(4)/342(1) of the BNS. As the petitioner was working as Dealing Assistant in the Office of the DTO Bongaigaon, he has been arrested in connection with this case due to anomalies relating to registration of vehicle No.AS-19/AC-6339. At present the petitioner is apprehending that he will be shown arrested in connection with the present case due to anomalies in registration of vehicle bearing registration No. AS-17C 6217.

¶4I have considered the submissions at the bar with circumspection. I have also perused the Case Diary. The petitioner has appeared before the Investigating Officer and has cooperated with the investigation. The petitioner has not violated any bail conditions. Henceforth, the interim order dated

03.10.2024 is hereby made absolute under the same terms and conditions.

¶5In terms of above observation, this Anticipatory Bail application stands disposed of.
