Faijul Islam and 3 Ors v. The State of Assam

ORDER 18-11-2024 Heard Mr. P Sharma, learned counsel for the petitioners and Mr. K K Parashar, learned Additional Public Prosecutor, Assam for the State.

¶2By this application under Section 439 of the CrPC, the petitioners, namely, (i) Faijul Islam, son of Fakrul Islam; (ii) Bulbul Hussain, son of Rahman Ali; (iii) Tabjul Ali, son of Kazim Ali, all resident of village-Japia, P.S.-Hajo, District-Kamrup and (iv) Safikul Islam, son of Motiur Rahman, resident of village-Dumoria, Part-I, P.S.-Abhayapuri, District-Bongaigaon are seeking bail in Sonai Police Station Case No. 94/2024 registered under Sections 319(2)/336(3)/3(5) of BNS, 2023, corresponding to G.R. No. 1910/2024, wherein they were arrested on 17.10.2024 and are in custody since then.

¶3During the deliberation of the matter, Mr. K K Parashar, learned APP, Assam, on instruction, has submitted that police after completion of the investigation of the case has already submitted Charge-Sheet in said Sonai Police Station Case No. 94/2024 vide Charge Sheet No. 83/2024 dated 30.10.2024.

¶4In view of the above, the petitioners are directed to appear before the appropriate forum/authority for their regular bail in said Sonai Police Station Case No. 94/2024.

¶5Accordingly, this bail application stands disposed of.
