Rajesh Kalita v. The State of Assam

ORDER 18-11-2024 No representation on behalf of the petitioner on call, though names of two counsels have been reflected in the cause list.

¶2Heard Mr. K K Parashar, learned Additional Public Prosecutor, Assam for the State.

¶3After obtaining interim bail by the petitioner, namely, Rajesh Kalita, in Basistha Police Station Case No. 244/2024 registered under Section 381 IPC, the petitioner remained un-Page No.# 2/2 represented on the last five occasions, i.e., 22.07.2024, 20.08.2024, 26.09.2024, 23.10.2024 and 25.10.2024, though names of two counsels for the petitioner have been reflected in the cause list and the interim bail granted to him has been extended till date.

¶4During the deliberation of the matter, Mr. K K Parashar, learned APP, Assam, on instruction, has submitted that police after completion of the investigation of the case has already submitted Charge-Sheet in said Basistha Police Station Case No. 244/2024 vide Charge Sheet No. 562/2024 dated 30.09.2024.

¶5In view of the above, the petitioner is directed to appear before the appropriate forum/authority for his regular bail in said Basistha Police Station Case No. 244/2024 on or before 27.11.2024.

¶6Till then, i.e., 27.11.2024, interim bail granted to the petitioner on 26.06.2024 in said Basistha P.S. Case No. 244/2024 shall remain in force.

¶7Accordingly, this pre-arrest bail application stands disposed of.
